New laws brought introduced in 2004 explicitly place a duty on the employer/occupier/managing agent to:

• Take reasonable steps to locate and assess asbestos in properties
• Presume material contain asbestos unless strong evidence they don’t
• Prepare a record of the location and condition of asbestos material and the risk they pose to occupants of the premises and maintenance workers
• Remove asbestos that can not be managed in situ

• principally aimed at commercial properties: but
• also residential where there are shared/common areas

NON COMPLIANCE CAN RESULT IN  PROSECUTION BY THE HSE
